Welcome to Forever Brand (foreverbrand.co.ke). By accessing our website, placing an order, or using our services (including custom printing, promotional merchandise, corporate gifts, and packaging solutions), you agree to be bound by the following Terms and Conditions.

Please read these terms carefully before placing your order. If you do not agree with any part of these terms, you must not use our services.

1. General Overview

Forever Brand acts as a service provider and print house. We provide custom branding, promotional items, and gift packaging to businesses, organizations, schools, and entrepreneurs across Kenya.

These Terms and Conditions apply to all orders placed with us, whether online, via phone, email, or in-person at our physical location.

2. Acceptance of Orders

All orders placed with Forever Brand are subject to our acceptance.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or if we suspect fraudulent or unauthorized activity.

Once you place an order, we will send you an order confirmation via email or SMS. This confirmation does not guarantee acceptance; it is an acknowledgment that we have received your request.

3. Custom Artwork, Logos & Intellectual Property

Because we specialize in custom printing, the following provisions are critical:

Customer Warranty: By submitting any artwork, logo, slogan, design, or text to Forever Brand, you warrant and represent that you own the rights to use that content, or that you have obtained express written permission from the rightful owner.

Indemnification: You agree to indemnify and hold Forever Brand harmless from any claims, damages, or expenses (including legal fees) arising from the unauthorized use of copyrighted, trademarked, or proprietary materials that you provide to us.

Design Assistance: If you request our design team to create or modify artwork for you, the final proof remains our intellectual property until full payment is received. Upon full payment, you are granted a non-exclusive license to use the final printed design for your business purposes.

Color Accuracy: We make every effort to match colors based on the digital files you provide. However, please note that screen displays and digital proofs may vary slightly from the final printed product due to monitor calibration and printing substrate (material) differences.

4. Pricing and Payment

Quotations: All quotes provided by Forever Brand are valid for the period stated in the quotation (typically 7–14 days) and are subject to change.

Payment Terms: Full payment is required before production begins, unless a specific credit arrangement has been agreed upon in writing for bulk corporate clients.

Accepted Methods: We accept M-Pesa, bank transfers, and other payment methods as displayed on our website or invoice.

Taxes: All prices are inclusive of VAT unless otherwise stated.

5. Shipping and Delivery

Delivery timelines and policies are detailed in our separate Shipping and Delivery Policy.

While we strive to meet the 24–72 hour turnaround, production times are estimates and may be affected by design approvals, material availability, or force majeure.

We are not liable for delays caused by third-party courier partners (e.g., traffic, weather, or logistical backlogs) after the order has been dispatched.

6. Returns, Refunds, and Cancellations

Due to the custom nature of our products, our return policy is limited:

Custom/Promotional Items: Because all printed and branded items are made specifically to your design and specifications, they are strictly non-returnable and non-refundable once production has commenced, except in cases of a manufacturing defect or printing error on our part.

Defective Items: If you receive a product that has a clear manufacturing defect or a printing error (e.g., we printed the wrong logo against your approved proof), you must notify us within 48 hours of receipt. We will reprint the order or issue a refund at our discretion.

Order Cancellation: You may cancel an order without penalty only if production has not started. Once production begins (which may occur immediately after proof approval), cancellation is not possible, and you will be liable for the full cost.

Approved Proofs: We are not responsible for errors on the final printed product if they were present in the final proof that you approved. It is your responsibility to thoroughly check spelling, contact details, and layout before giving final approval.

7. Limitation of Liability

Forever Brand provides its products and services on an “as is” and “as available” basis.

To the fullest extent permitted by Kenyan law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Forever Brand shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our products or services.

8. Force Majeure

We shall not be held liable for any failure or delay in performance of our obligations resulting from circumstances outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, government actions, natural disasters, fires, pandemics, or supplier failures.

9. User Accounts and Conduct

If you create an account on our website, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree not to use our website for any unlawful purpose or in any way that could damage, disable, or impair the site.

10. Privacy and Data Protection

Your privacy is important to us. The collection and use of your personal information are governed by our Privacy Policy, which complies with the Kenya Data Protection Act, 2019. Please review our Privacy Policy to understand how we handle your data.

11. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya.

Any dispute, controversy, or claim arising out of or relating to these terms shall first be attempted to be resolved through friendly negotiation.

If the dispute cannot be resolved amicably within 14 days, it shall be submitted to the exclusive jurisdiction of the courts of Kenya in Nairobi.

12. Amendments to These Terms

Forever Brand reserves the right to update or modify these Terms and Conditions at any time without prior notice. Changes will become effective immediately upon posting to this page. It is your responsibility to review these terms periodically.
